Rafael Garcia, 44, is charged with conspiracy to violate drug laws, obtaining drugs by fraud and larceny of a drug, the Suffolk County District Attorney's Office said.
A pharmacist became suspicious of Boston Medical Center nurse practitioner John Cann for writing several prescriptions that seemed suspicious, the prosecutor said. Garcia and Cann worked together in the emergency department.
The investigation showed that even though Garcia wasn’t his patient, Cann prescribed him several medications, including:
- Clonazepam
- Adderall
- Dextroamphetamine
- Androderm patches
- Injectable testosterone
Cann picked up most of the drugs he prescribed for Garcia himself between February 2021 and June 2023, according to Suffolk District Attorney Kevin Hayden.
The DA said Garcia used his health insurance to pay for the prescriptions.
Cann appeared in Malden District Court earlier in 2023 on charges involving writing improper prescriptions at a Malden pharmacy for:
- Adderall
- Lorazepam
- Amphetamine ER
Garcia faces charges in Suffolk District Court, including:
- Conspiracy to violate drug laws
- Obtaining drugs by fraud
- Larceny of a drug
His bail is set at $2,500, the prosecutor said.
